PRIVACY POLICY OF LE MONITEUR AUTOMOBILE

 

1. General information about the data controller

This Policy is established by ProduPress S.A., the publisher of the website https://moniteurautomobile.be (hereinafter the“website” ), whose registered office is located at 54 Avenue Herrmann-Debroux  - 1160Auderghem, registered under company number BE 0650.876.928 (hereinafter referred to as“ProduPress” or the“Data Controller ”).

Entirely dedicated to the automotive industry, ProduPress (hereinafter referred to as“we,“our,”or“us”) is a media group that is the leader in Belgium in the distribution of automotive news in print and online (automotive magazines and websites).

Under the GDPR, ProduPress is considered the data controller, that is, the entity that determines the purposes and means of data processing in the course of our activities.

 

2. Importance of this Privacy Policy

Data protection and respect for your privacy are core values for us, and we are committed to processing and protecting your personal data fairly and transparently, in accordance with the law.

This Policy reflects our commitment to acting with full transparency, in compliance with the Act of July 30, 2018, on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as the “Privacy Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to asthe “GDPR” ). 

As part of our business operations, we process personal data. The purpose of this Policy is to explain how we collect, use, and store your personal data.

By“personal data,” we mean all personal data relating to you, that is, any information that allows you to be identified, directly or indirectly, as a natural person.

"Processing" of personal data means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means. In other words, processing consists of various actions related to personal data, such as recording, erasing, storing, using, collecting, modifying, or accessing personal data.

 

3. What categories of personal data do we process, and how do we obtain them?

3.1. Categories of personal data collected

In particular, we collect and process the following information:

Examples: last name, first name, date of birth, city, mailing address, phone number, email address.

  • Vehicle type data

Examples: make, model, transmission, fuel economy, date of first registration.

  • Lifestyle data 

Examples: information about the consumption of goods or services.

  • Information about your interests

Examples: Areas of interest derived from technical data and information about website usage

  • Billing Information

Examples: When you order a magazine or a subscription, this information is required so that we can process your order and verify your payment (cardholder name, card number, expiration date).

  • User account login information

Examples: username and password to log in to your user account.

  • Technical information and information about the use of the website (cookies)

When you use our services, our servers automatically record certainlog file information.

These files may include information such as your connection details (IP address), your cookie ID, browser type, referring/exit pages and URLs, the device used, location data if this feature has been enabled by the user, the number of clicks and how you interact with links on the website, domain names, your consent string, pages viewed, and other similar information.

3.2. Background and Data Collection Methods

We may collect personal data in various ways:

  • When you create an account on the website;
  • When you enter or update your account information (personal contact details, My Profile, My Preferences, etc.);
  • When you contact us via the contact form on the website or by email;
  • Through business development activities (promotional emails, newsletters, auto shows and events, etc.);
  • By subscribing to our magazines or other subscriptions;
  • By entering our contests;
  • By participating in our discussion forums;
  • Additional information may also be collected through cookies, regardless of whether you choose to enable them, allowing us to provide you with a better user experience and improve our website.

 

4. For what purposes do we collect your data, and on what legal basis?

The GDPR permits the processing of personal data provided that it is based on one of the legal grounds set forth in the GDPR and is carried out for specific purposes.

We collect and process your personal data for the purposes described below. We ensure that only necessary and relevant personal data is processed, in accordance with the principle of data minimization.

In general, we process your personal data based on the following legal grounds:

  • In order to comply with our legal obligations;
  • In order to take the necessary steps and fulfill the contract between us when you use one of our products or services;
  • In order to pursue our legitimate interests (in such cases, we always take care to strike a balance between our legitimate interests and your rights and freedoms);
  • Finally, based on your free and informed consent.

In the event that we need to process your personal data for purposes not yet covered by this Policy, we may use your personal data provided that such purposes are compatible with the purposes for which we originally collected your data. We take into account any connection between the initial and subsequent purposes, as well as the context in which the data is collected. If we determine that the purposes are incompatible with the initial purposes, we will contact you before using your personal data. The purpose of this contact will be to inform you about this processing and, if necessary, to request your consent for this subsequent processing.

4.1. Compliance with our legal obligations

4.2. To take steps prior to entering into a contract and to perform the contract between us when you use one of our products or services or when you have an account on our website

  • Manage your orders (online subscription / magazine);
  • Delivery of your purchases;
  • Managing registrations for one of our auto shows and events;

4.3. In pursuit of our legitimate interests

In certain cases, it is in our legitimate interest to process your personal data. To that end, we always strive to strike a fair balance between the need to process your personal data and the protection of your rights and freedoms.

This is the case when ProduPress pursues a legitimate interest—that is, one that is not contrary to the law—when the processing of personal data is necessary to fulfill that legitimate interest, and when the rights and freedoms of the data subjects are not significantly affected by the pursuit of that legitimate interest.

For example, ProduPress has a legitimate interest when data processing takes place in the context of a customer relationship, or to prevent fraud, or to ensure the security of networks and information in computer systems.

Your personal data is therefore processed on the basis of our legitimate interests, in particular for the following purposes:

  • Identification and management of users on the website;
  • Sales prospecting (sending information about our products and services) and lead management (updating prospecting databases, organizing promotional campaigns, making sales-related contacts, etc.);
  • Managing user reviews of products, services, or content;
  • The preparation of studies, models (including risk, marketing, and other models), and statistics, using anonymization and/or pseudonymization techniques whenever possible;
  • Ensuring the safety of people and property, the security of networks and computer systems, and combating fraud, attempted intrusions, abuse, and other violations;

5. How long do we retain your personal data?

As a general rule, we take care not to retain your personal data for longer than is necessary for the purposes for which it was collected.

More specifically, several different situations must be considered when determining how long your personal data will be retained:

  • With regard to regular use of our website, users retain their user accounts as long as they remain active. In other words, we retain your data for the duration of your registration. However, you can delete your account at any time;
  • If you are subscribed to one of our newsletters, we will retain your data for as long as you remain subscribed. However, you can unsubscribe from our newsletter at any time, either through your user account or by clicking the unsubscribe link at the bottom of our newsletters;
  • If you have subscribed to one or more magazines, we will retain your personal data for the duration of your subscription in order to provide you with the magazine(s) in accordance with the terms of your subscription;
  • Please note that in connection with the performance of a contract between us ( for example, a subscription to one of our magazines), we retain your personal data for a period of ten (10) years following the termination of the contract, in accordance with applicable laws;
  • For marketing purposes, if you do not respond to any communications for three (3) years following your last contact with us, your information will be deleted;
  • If you enter one of our contests, we will retain the personal data you provide in connection with the contest for the duration of your participation and the contest itself. Once the winner(s) has/have been selected, the personal data of the other participants will be deleted as soon as possible.

Once the retention period has expired, we take every measure to ensure that your personal data has been rendered unavailable and inaccessible.

 

6. Your rights under the GDPR

Under the GDPR, your rights allow you to maintain control over how we use your personal data.

6.1. Right of Access and Copying

This right allows you, in particular, to ask us whether we are processing your personal data, for what purposes, what categories of data are involved, and who the recipients of your data are. You may also request a copy of all the personal data we process about you.

6.2. Right to Withdraw Your Consent

You also have the right to request that we correct any information about you that is inaccurate, incomplete, or out of date at any time.

If you have a user account, you can also update your personal information via the "My Account" section of Moniteur Automobile and the "My Contact Information and Login" section.

6.4. Right to be forgotten

You may request the erasure of your personal data if any of the following grounds apply:

  • The data is no longer necessary for the purposes of the processing;
  • You withdraw your consent to the processing of your data, and we base this processing solely on the legal basis of your consent;
  • You object to the processing;
  • We have processed your personal data unlawfully;
  • If the data we have is incomplete, inaccurate, or out of date;
  • We must delete your personal data in order to comply with a legal obligation (under European Union law or the law of a Member State) to which we are subject.

You can also ask us to delete your account at any time, free of charge.

6.5. Right to data portability

If we process your personal data based on a contract or your consent, you may ask us to provide you with a copy of all your personal data or to transfer it to another data controller, if applicable.

6.6. Right to restriction of processing

In certain cases, you may also ask us to restrict the processing of your personal data. The situations in which you may ask us to restrict the processing of your personal data are as follows:

  • If you dispute the accuracy of any personal data, we will restrict the processing of your personal data until we can verify the accuracy of that data;
  • If we process your personal data unlawfully and you would prefer that we restrict such processing rather than erase your personal data.

Of course, as soon as the restriction on processing no longer applies, we will notify you.

6.7. Right to object

When your data is processed for direct marketing purposes, you have the right to object, at any time, to the processing of your personal data for direct marketing purposes.

Every time you receive an email from us, you have the option to unsubscribe from our direct marketing mailing list. If you choose to unsubscribe, we will process your request as soon as possible. You understand, acknowledge, and agree that it may take some time for us to process and apply your unsubscribe request.

In addition, when we process your personal data based on our legitimate interests, you may object to the processing of your data if you can demonstrate that your particular situation warrants it.

6.8. Right not to be subject to automated processing, including profiling

To provide you with a better experience, we use profiling techniques to match you with certain preferences or interests. Whenever possible, we will use only anonymized or pseudonymized data.

Profiling, as defined by the GDPR, is any form of automated processing of personal data that involves using such data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s personal preferences, interests, behavior, location, or movements.

When we use your personal data to associate you with certain preferences or interests, we ensure that no fully automated decision (i.e., without any human intervention) that has legal effects or similarly significantly affects you is made. If you believe that you are subject to a decision based solely on automated processing, you have the right to object to it.

Please note that such decisions are permissible if they are necessary for the conclusion or performance of a contract between you and us, or if you have given your explicit consent. In addition, if permitted by law, we may also process your data automatically.

 

7. How can you exercise your rights?

7.1. Contact Us

If you wish to exercise any of your rights, you can contact us in a variety of ways, at any time, easily and free of charge:

In order to help you exercise your rights, and when the circumstances warrant it, we must take all reasonable steps to verify your identity. Accordingly, if there is reasonable doubt regarding your identity, we may ask you to verify your identity by providing us with additional information.

If you do not provide us with this additional information to identify you, we are not required to respond to your requests to exercise your rights, as we will be unable to identify you.

7.3. When will we get back to you?

We are committed to responding to you as soon as possible, and no later than thirty (30) calendar days from the date we receive your request.

This timeframe may be extended to a maximum of two (2) months if your request is complex and/or we are experiencing a high volume of requests. Should such a situation arise, we will inform you of the reasons for the delay.

7.4. Free of charge

We respond to requests for the application of the law free of charge. However, we may ask you to pay a reasonable fee based on administrative costs in advance for any additional (paper) copies you request, or if your request is clearly unfounded or excessive.

 

8. Disclosure to third parties

In some cases, we may need to share your personal data with other third parties.

8.1. Subcontractors

To enable you to access, improve, and use the website, we work with third-party service providers who may have access to your personal data when necessary for the provision and optimization of our services. For example, these may include contractors responsible for maintaining our infrastructure, external IT consultants, software providers, payment partners, delivery services, and any other partners we may need to engage in the course of providing our services.

If this is the case, we ask them to ensure compliance with applicable laws and regulations and to strictly maintain the confidentiality of any information they may handle in the course of their work.

We work with a number of carefully selected business partners. In this context, we may need to share certain personal data with them if you give us your consent. You will be notified in advance so that you can decide whether or not to consent to this type of processing.

When you browse our websites or use our mobile apps, and when you enter your email address on them (whether to log in, subscribe to a newsletter, or for other purposes), we may share with our partner LiveRamp and its group companies, acting as joint data controllers, the personal data we collect from you, such as your email address (in hashed and pseudonymized form), your IP address, your mobile advertising ID, or information about your browser or operating system. 11. Governing Law and Jurisdiction

This Policy is governed by Belgian law.

Any dispute shall first be subject to an attempt at discussion and amicable resolution. If such amicable resolution fails, any dispute relating to the interpretation or enforcement of this Policy shall be governed by Belgian law and shall fall under the exclusive jurisdiction of the courts of the judicial district of Brussels.
